Hoàn thiện chính sách về đấu giá sáng chế tại Việt Nam

Abstract

In the modern knowledge-based economy and the context of the Fifth Industrial Revolution (Industry 5.0), patents in particular and intellectual property in general have become core resources determining the competitiveness of each nation. Commercializing patents through asset auction is an advanced, transparent solution that optimizes market value; it has been successfully applied in many developed countries around the world such as the United States, China, and European countries. However, in Vietnam, the patent auction mechanism is still in its development stage, facing many legal obstacles from valuation and regulations on public asset management to building exchange infrastructure and enhancing market awareness. This article will focus on analyzing the current state of legal policies on patent auctions in Vietnam, comparing them with and drawing lessons from international experience. Therefore, proposals are put forward to improve the legal framework for patent auctions, contributing to the expansion of intellectual property commercialization and promoting the national innovation ecosystem in the future.
